New responsibilities for homeowners under Safety, Health and Welfare at Work (Construction) Regulations 2013

As well as the forthcoming changes to the Building Regulations in March 2014; last week saw the signing into law of the new Safety, Health and Welfare at Work (Construction) Regulations 2013.

These regulations have big repercussions on anyone contemplating construction work where:

  • There is more than one contractor involved in the work, or
  • There is a particular risk (details on risks by downloading the hsa document above)
  • The work is going to last more than 30 days or more than 500 person days.

 
The regulations will effectively come into play for any type of extension or domestic work as they do not apply when there is only one contractor; this is going to be rare on domestic work as you will generally need plumbers, electricians etc…

The upshot is that you will need to appoint a Project Supervisor Design Process (PSDP) who passes on the safety file onto the Project Supervisor Construction Stage (PSCS); generally these will be the architect as PSDP and the main contractor as PSCS although if suitably qualified they can be the same person.
